Terms of Service

1. Acceptance

By accessing or using ETHRAEON Systems public surfaces, products, or services, you agree to be bound by these Terms of Service. These terms describe the intended use of ETHRAEON materials, products, and public documentation. Enterprise engagements and paid product tiers may be governed by a separate written agreement; that agreement controls where it conflicts with these terms.

2. Platform Purpose

ETHRAEON provides constitutional governance runtime, evidence control layer capabilities, sovereign AI orchestration, and related tooling. Public surfaces provide documentation, evidence, technical information, product marketing, and access paths to paid products. Content is provided as-is for informational or product-service purposes.

4. Intellectual Property

All platform technology, including the constitutional governance framework, evidence control mechanisms, EUDS design system, product source, published papers, and 16 provisional patent applications filed with USPTO (73 specifications, 9 patent families), is the intellectual property of S. Jason Prohaska (ingombrante) and ETHRAEON Systems, protected under Schedule A+ Enhanced IP Firewall. Unauthorized reproduction, distribution, or commercial use is prohibited.

5. Evidence Artifacts

Evidence artifacts (patents, valuations, operational proofs, seal chain entries) are immutable and cryptographically hashed. These materials are provided for verification and transparency. They do not constitute offers, solicitations, or binding commitments unless expressly identified as such.

6. No Investment or Financial Advice

Content on ETHRAEON surfaces does not constitute investment, legal, tax, or financial advice. Valuation materials are informational only. Prospective investors must conduct independent due diligence and are directed to executed SAFE, LOI, and MNDA instruments where applicable.

7. Founder Sovereign Authority

ETHRAEON operates under an founder sovereign authority model. S. Jason Prohaska (Founder, CEO) retains authority to suspend access, halt platform operations, override non-immutable configuration, revoke API access in security emergencies, and enforce the constitutional governance framework. These sovereign acts are exercised with proportion and evidence, and are subject to the append-only audit trail.

8. Availability and Warranty Disclaimer

The platform is provided without a promise that every feature will be uninterrupted or error-free. ETHRAEON surfaces and products are provided "as-is" and without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Paid products may carry a separate service level agreement.

9. Limitation of Liability

To the fullest extent permitted by law, ETHRAEON Systems and S. Jason Prohaska (ingombrante) disclaim liability for indirect, incidental, consequential, or punitive damages arising from use of or inability to use these materials or services. Total aggregate liability for a paid product is limited to the amount paid by the customer for that product in the twelve months preceding the claim.

ETHRAEON surfaces may link to external resources. ETHRAEON is not responsible for external content, privacy practices, or terms of third-party sites.

11. Data and Privacy

Data collected in connection with these services is handled per our Privacy Policy. Cookie use is described in our Cookie Policy. Security posture is described at our Trust Center.

12. Changes

These terms may be updated. Material changes will be reflected with an updated last-updated date. Continued use of ETHRAEON surfaces after an update constitutes acceptance of the updated terms.

13. Governing Law and Jurisdiction

These terms are governed by applicable law consistent with ETHRAEON Systems' jurisdictional posture. Disputes are subject to appropriate jurisdiction as set forth in an executed engagement instrument where one exists, or as required by the law of the customer's residence for consumer contracts. Enterprise engagements typically specify Delaware, USA or a mutually agreed EU forum.
